Traffic Management Act 2004 - Part 6

The Department for Transport (DfT) announced in 2020 that they would be fully enacting the remaining elements of the Traffic Management Act, permitting local highway authorities to use approved camera devices to enforce moving traffic contraventions. The legislation has now been passed by Government, and we are proposing to introduce the use of the new powers.

The Council are preparing for these powers to be adopted to improve road safety, reduce congestion and decrease pollution. Our first step in the process is to apply to DfT to be included as one of the authorities that can enforce key highway restrictions or prohibitions.

These include:

  • driving through a 'No Entry' sign.
  • making banned turns when instructed not to do so.
  • entering yellow box junctions when the exit is not clear.
  • driving where and when motor vehicles are prohibited e.g. weight limited, School street.
  • driving on routes that are for buses, taxis and bicycles only.

These powers form Part 6 of the Traffic Management Act 2004 which were previously only enforced by the police under criminal law.

We will be seeking to use the latest Automatic Number Plate Recognition (ANPR) technology to identify any moving traffic offences and a penalty charge notice (PCN) will be issued through the post. The aim of these enforcement powers is to:

  • increase the number of drivers complying with the rules of the road.
  • improve road safety.
  • tackle congestion issues.
  • improve air quality and reduce emissions from standing traffic.
  • increase public transport reliability.
  • invest in cleaner sustainable travel initiatives.
  • increase lifespan of highways assets


In line with legislation, any income from the PCNs issued will be reinvested back into projects that improve road safety, increase active and sustainable travel, or achieves one of the above objectives.
