Statutory Investigation and Progression Policy - Consultation

The Environmental Protection Act 1990 (‘The Act’) sets out in legislation the matters that constitute statutory nuisance and provides specific powers to tackle nuisance. The Act also requires that the Council inspects its area from time to time to detect any statutory nuisance and to take such steps as are reasonably practicable to investigate the complaint.

The policy details what the Council can and cannot investigate with the legislation available. It also details what assistance is required from those alleging they are affected by statutory nuisance to support their complaint. The policy also sets out what the Council considers to be a reasonable investigation.

Consultation is open for 8 weeks from 9th May until 5pm on 27th June 2023
