Consultation has concluded

The Council operates in accordance with government guidance when enforcing legislation. This draft Private Rented Sector Enforcement Policy adheres to those principles and aims to provide additional clarity through the adoption of a specific policy. The consultation does not include the section relating to Civil Penalties as this has already been consulted on and is included as an appendix to the proposed policy.

The policy aims to provide a transparent rationale around how the service is provided to different tenures. It recognises that tenants are less able to influence the repair and maintenance of the properties they are living in, rather than those occupied by owner-occupiers. The policy also:

  • Details when formal enforcement against category 2 hazards will be considered
  • Sets out the electrical safety standards and how they will be applied within the private rented sector
  • Gives a statement of principles so that the penalties under the legislation relating to smoke and carbon monoxide alarms are applied
  • Details the circumstances when services should be withdrawn
